    Welcome to Vocaid ("we," "us," or "our"). Vocaid Technologies, Inc. is committed to protecting your privacy and ensuring the security of your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our AI-powered voice interview practice and recruitment platform (the "Service").

    By accessing or using Vocaid, you consent to the practices described in this policy. If you do not agree with any part of this policy, please discontinue use of our Service immediately.

    This policy applies to all users of our Service, including individual job seekers (B2C), organizational recruiters and hiring managers (B2B), and candidates invited to interview through organizational links.

    2. Information We Collect

    Personal Information

    We collect personal information that you provide directly to us, including:

    • Full name and email address
    • Account credentials (hashed and encrypted)
    • Phone number (for verification purposes)
    • Resume and professional information (job history, education, skills)
    • Date of birth (for age verification — you must be 18 or older)
    • Organization name and role (for B2B accounts)
    • Payment information (processed securely through Stripe — we do not store card numbers)

    Automatically Collected Information

    When you use our platform, we automatically collect certain information, including:

    • Device information (browser type, operating system, device model)
    • IP address and approximate geographic location
    • Usage patterns, page views, and session duration
    • Performance metrics and error logs
    • Referral source and landing page URL
    • Cookie identifiers and similar tracking technologies (see Section 12)

    AI and Computer Vision Processing

    When you use our interview features, our AI systems process the following data with your explicit consent:

    • Audio recordings of your interview responses
    • Video recordings of your interview sessions (when camera is enabled and consent is given)
    • Transcripts generated from your spoken responses via speech-to-text AI
    • Facial detection data for liveness verification and gaze tracking (not facial recognition — we do not identify individuals by face)
    • Voice characteristics including pace, tone, clarity, and filler word frequency
    • Behavioral signals including eye contact consistency, posture indicators, and response timing
    • AI-generated performance scores, feedback, and coaching recommendations

    3. Voice Processing Notice

    Vocaid uses advanced speech-to-text and voice analysis technology to process your spoken interview responses. This section provides specific details about how your voice data is handled.

    What We Process

    • Speech-to-text transcription: Your spoken words are converted to text in real-time using third-party AI services (Azure OpenAI, Deepgram). Audio is streamed, processed, and not permanently stored by these providers beyond the processing session.
    • Voice analysis: We analyze speech characteristics including pace (words per minute), use of filler words, pauses, sentence structure, and overall clarity to provide communication coaching feedback.
    • Voice patterns: Acoustic features of your voice may be analyzed as part of interview feedback. These patterns are considered biometric information under certain laws (see Section 7).

    What We Do Not Do

    • We do not create permanent voiceprints or voice identification profiles
    • We do not use your voice recordings to identify you across sessions or platforms
    • We do not sell, license, or share raw audio recordings with third parties for their own purposes
    • We do not use emotion inference or sentiment analysis on voice recordings (prohibited under EU AI Act Article 5(1)(f) for workplace contexts)

    Voice data retention: Raw audio recordings are retained for 30 days after each session, then permanently deleted. Derived analytics (scores, transcripts, feedback) are retained while your account is active.

    4. How We Use Your Information

    We use the information we collect for the following purposes:

    • Provide, maintain, and improve our interview practice and recruitment services
    • Generate personalized interview questions based on your resume, target role, and experience level
    • Produce performance analytics, scores, and coaching feedback from your interview sessions
    • Process audio and video recordings to deliver comprehensive interview feedback
    • Analyze behavioral signals through computer vision to enhance coaching (with your explicit consent)
    • Process payments, manage your subscription, and administer your account
    • Send transactional communications (interview results, account notifications, password resets)
    • Send marketing communications about tips and new features (only with your opt-in consent)
    • Ensure the security, integrity, and availability of our platform
    • Comply with legal obligations and respond to lawful requests from authorities
    • Conduct aggregated, anonymized analytics to improve our AI models (see Section 6)

    For users in the European Economic Area (EEA), United Kingdom, and Switzerland, we process your personal data under the following legal bases:

    1. Consent (Article 6(1)(a)): For biometric processing, video analysis, voice analysis, marketing communications, and optional AI training data usage
    2. Contract (Article 6(1)(b)): To provide the Service you have subscribed to, process payments, and deliver interview feedback
    3. Legitimate Interest (Article 6(1)(f)): For platform security, fraud prevention, and aggregated analytics
    4. Legal Obligation (Article 6(1)(c)): For tax records, law enforcement requests, and regulatory compliance

    5. AI and Automated Decision-Making

    Vocaid uses artificial intelligence throughout the interview process. We believe in transparency about how AI affects your experience.

    What Our AI Does

    • Generates tailored interview questions based on the job description and your resume
    • Conducts voice-based interviews using natural language processing
    • Transcribes your spoken responses in real-time
    • Scores your interview performance across multiple dimensions (communication, technical knowledge, problem-solving, cultural fit)
    • Provides detailed coaching feedback and improvement suggestions
    • Analyzes behavioral signals (with consent) including eye contact, posture, and engagement

    What Our AI Does Not Do

    • Make final hiring decisions — all AI outputs are recommendations, not decisions
    • Infer emotions or emotional states (prohibited under EU AI Act for workplace contexts)
    • Use facial recognition to identify individuals
    • Apply different scoring criteria based on race, gender, age, disability, or other protected characteristics
    • Share individual results with anyone without your consent (B2C) or your organization's authorized access (B2B)

    Human Oversight

    For B2B hiring workflows, AI-generated scores and analysis are presented as recommendations to human reviewers. Hiring managers retain full authority over hiring decisions. Candidates may request human review of any AI-generated score or assessment.

    Limitations

    AI-generated scores are probabilistic assessments, not objective measurements. Performance may vary based on language, accent, audio quality, internet connection, and other factors. Scores should be interpreted as one data point among many, not as definitive evaluations of a candidate's abilities.

    6. AI Training and Model Improvement

    We are committed to transparency about how your data may be used to improve our AI systems.

    If you opt in to AI model improvement during onboarding or before an interview session, your anonymized and aggregated interview data may be used to improve Vocaid's AI models. This includes anonymized transcripts, scoring patterns, and aggregated behavioral signals.

    We do not use your raw audio recordings, video recordings, or personally identifiable information for AI training. All training data is irreversibly anonymized before use.

    You can opt out of AI training data usage at any time through your account settings or by contacting us at support@vocaid.ai. Opting out does not affect your access to or experience with the Service.

    Third-Party AI Services

    We use the following third-party AI services to power our platform. Your data is processed under our Data Processing Agreements with each provider:

    • Azure OpenAI Service (Microsoft): Powers interview conversation, question generation, and scoring. Data is not used to train Microsoft's models.
    • Deepgram: Provides real-time speech-to-text transcription. Audio is processed in real-time and not retained.
    • Azure Face API (Microsoft): Used for face detection and liveness verification only (not facial recognition). No Limited Access features are used.

    7. Biometric and Sensitive Data

    Our Service processes data that may be classified as biometric information under various laws, including voice patterns from audio recordings and facial geometry data from video recordings used for liveness verification and gaze tracking.

    We do not sell, lease, trade, or otherwise profit from your biometric data. Biometric data is never shared with third parties for their own commercial purposes.

    Illinois BIPA Notice

    If you are a resident of Illinois, the Biometric Information Privacy Act (740 ILCS 14) provides you with specific rights regarding your biometric data. We provide this written notice and obtain your written consent before collecting biometric identifiers or biometric information. You may contact us at support@vocaid.ai to exercise your BIPA rights.

    Purpose of Collection

    We collect voice patterns and facial geometry data solely for the purpose of providing interview feedback, coaching recommendations, and liveness verification. This data is not used for identification purposes.

    Consent

    We process biometric data based on your explicit, informed consent provided before each interview session. You may choose to participate in audio-only mode without video recording or behavioral analysis at any time.

    Retention and Destruction

    • Raw audio recordings: Retained for 30 days, then permanently deleted via secure erasure
    • Raw video recordings: Retained for 30 days, then permanently deleted via secure erasure
    • Facial detection data: Processed in real-time during sessions; raw data not stored beyond the session
    • Derived scores and feedback: Retained while your account is active; deleted within 30 days of account deletion
    • Liveness verification results: Pass/fail result stored; raw biometric data deleted immediately after verification

    8. Data Sharing and Transfers

    We share your personal data only in the following circumstances:

    • Service Providers: With trusted third-party providers who process data on our behalf (cloud hosting, payment processing, AI services) under strict Data Processing Agreements
    • B2B Organizations: If you are a candidate invited through an organizational link, your interview results and scores are shared with the inviting organization as disclosed before your interview
    • Legal Requirements: When required by law, subpoena, court order, or government regulation
    • Business Transfers: In connection with a merger, acquisition, or sale of assets (you will be notified)
    • With Your Consent: In any other circumstance where you have provided explicit consent

    Cross-Border Data Transfers

    Vocaid operates globally. Your data may be transferred to and processed in countries other than your country of residence, including the United States. For transfers from the EEA, UK, or Switzerland, we rely on Standard Contractual Clauses (SCCs) approved by the European Commission. For transfers from Brazil, we use ANPD-approved transfer mechanisms under the LGPD.

    A current list of our sub-processors and their processing locations is available upon request by contacting support@vocaid.ai.

    9. Data Retention

    We retain your data for the following periods:

    • Account Information (name, email, profile): While your account is active + 30 days after deletion request
    • Audio Recordings: 30 days after each session, then permanently deleted
    • Video Recordings: 30 days after each session, then permanently deleted
    • Transcripts: While your account is active; deleted within 30 days of account deletion
    • AI-Generated Feedback and Scores: While your account is active; deleted within 30 days of account deletion
    • Resume Data: While your account is active; deleted within 30 days of account deletion
    • Behavioral Analysis Data: Processed in real-time; derived scores retained while account is active; raw analysis data deleted within 30 days
    • Payment Records: 7 years as required by applicable financial regulations
    • Consent Records: 7 years for legal compliance
    • Aggregated Analytics: Indefinitely (fully anonymized, cannot be linked to individuals)

    You may request earlier deletion of your data (except where retention is legally required) by contacting us at support@vocaid.ai or through your account settings.

    10. Your Rights

    Depending on your jurisdiction, you may have specific rights regarding your personal data. Select your region below to see the rights that apply to you.

    Withdraw consent at any time for processing based on consent, without affecting prior lawful processing

    11. Children's Privacy

    Vocaid is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from children under 18. All users must verify their age during account creation.

    If we learn that we have collected personal information from a child under 18, we will take immediate steps to delete that information. If you believe a child under 18 has provided us with personal information, please contact us immediately at support@vocaid.ai.

    13. Changes to This Policy

    We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors.     Your continued use of the Service after the effective date of the revised policy constitutes your acceptance of the changes. We encourage you to review this page periodically.
